EAA fines explained: What every marketer needs to know

What's changed?
With the introduction of the European Accessibility Act (EAA) on June 28th 2025, all EU member states are now enforcing penalties for digital inaccessibility. That includes emails. Each country has published its own rules, including the size of potential fines and whether individuals can bring claims directly.
Below is a country-by-country breakdown, linking to each country’s specific law or business guide.

*Bulgaria has been referred to the European Court of Justice for failing to implement the EAA by June 28th - the law is still being confirmed. Pounds sterling based on conversion rate 28/07/25.
Why it matters if you’re in the UK or US
Think your business is safe because you're not based in the EU? Think again.
The EAA applies to any business with EU-based customers including email subscribers. If you send a marketing or transactional email to someone whose primary residence is in the EU, you're legally required to meet accessibility standards. If you don’t, you’re liable for the fines outlined above.

Some countries are far stricter than others. Luxembourg and Spain currently top the list:

Yes, it’s that serious. In Cyprus and Ireland, you could face criminal charges and prison time:
